Holiday Claims Bureau has scored a big win for their client who suffered a serious injury at work. The individual sustained an injury that rendered them permanently unable to continue in their job. Our holiday accident
It was a cold March morning in 2019 on an offshore oil rig off the coast of Great Yarmouth in Norfolk when Ross Lewis, a Rope Access Rigger from Stockport, had his life turned upside down by a seemingly innocuous incident.
Ross was walking on a walkway on the rig when he tripped over an unattended bag that had been left on the floor. Falling to the floor, Ross landed on his outstretched hand, causing a severe injury. A first aid responder helped him to his feet, after which he was repatriated to hospital.
Ross subsequently received the unfortunate news that he had ruptured his biceps tendon and required surgery right away. After the procedure, he was ordered to keep his arm in a sling for six weeks.
A settlement negotiated
Holiday Claims Bureau, an expert law firm in litigating slip, trip, and fall cases arising from organisational negligence, took up Ross’ case after he contacted them once he was released from hospital.
Under a no-win, no-fee agreement, the firm’s head of litigation, solicitor Michael Walker, led the charge, quickly securing an admission of liability and arranging for Ross to undergo a specific rehabilitation program.
They fought tirelessly to secure the compensation he deserved, successfully winning him £50,000 for the injury he sustained.
“This was a very complex case, mainly because the accident happened whilst Ross was working off-shore and he suffered a serious injury with long-term consequences,” Walker explained.
“Our team has expertise in managing cases related to offshore accidents, so we managed to secure an admission of liability promptly. We also arranged for Ross to undergo a specialised rehabilitation program to improve his bicep function”.
A change of roles
The Holiday Claims Bureau team successfully obtained expert medical evidence from an orthopaedic surgeon that revealed Ross was no longer able to work in his profession as a Rope Access Rigger due to the loss of strength in his right arm. In fact, even turning on a light switch proved difficult.
Once the medical evidence was finalised, Holiday Claims Bureau obtained evidence relating to Ross’ past and future earnings to support his change in employment. They then entered into negotiations with the Solicitors for the Defendant. As a result, Holiday Claims Bureau facilitated Ross’ career pivot.
He was subsequently appointed as a height safety supervisor, which allowed him to continue to utilise his previous experience while avoiding the physical aspects of his former job
“This has been a very difficult time for me, but Michael and the team helped me throughout the case and arranged treatment for my injuries so I could make the best recovery possible,” Lewis remarked.
“This settlement will enable Ross to move on from this terrible experience and look forward to working in his new found career. Ross was grateful for the support he received from the Holiday Claims Bureau team,” Michael Walker said.
