Holiday Nightmare: Guests Receive £2,700 Compensation After Gastric Illness at RIU Funana in Cape Verde
During their holiday at the popular Riu Funana hotel in Cape Verde, guests Lilly (30 years old) and Jordan (27 years old) fell seriously ill due to suspected food contamination. They experienced severe gastric distress, including diarrhoea and stomach cramps, starting on September 28, 2022. This illness prevented them from enjoying the hotel amenities and even confined Lilly to her room on the final day of their stay. When they returned home, Lilly’s symptoms worsened, prompting her to seek medical attention.
Due to the hotel’s history of similar incidents, the Claimants believed the hotel was responsible for their suffering so they decided to take legal action.
Holiday Claims Bureau instructed
“It was horrendous,” said Lilly. “I suffered a lot of abdominal pain and was unwell due to my symptoms at the time. I couldn’t eat, had no energy, and the entire holiday was ruined. After I came home, I had to book an appointment with my local GP, and it took me almost a month to fully recover.
“Both of us only ate and drank at the resort. We’ve never experienced anything like it and decided to see if we could get compensated for the illnesses we suffered and how it affected our holiday.
“No one should have a hard-earned holiday ruined due to poor food and hygiene standards, and we’re so thankful we found Holiday Claims Bureau. They have been extremely supportive from the start and helped us to achieve the best possible outcome for our claim,” Lilly added.
The case was taken on by Michael Walker, a Partner Solicitor at Holiday Claims Bureau, renowned for his expertise in holiday illness and accident claims. Mr. Walker highlighted the prolonged suffering experienced by Lilly, emphasizing the urgent need for hoteliers to implement stringent preventive measures to safeguard guests from contracting similar illnesses in the future.
“The symptoms Lilly and Jordan suffered could have been prevented and caused a great deal of discomfort and unrest, particularly for Lilly, upon their return home.
“When guests have booked an all-inclusive package holiday, they expect the experience to be of a high standard in every aspect, especially the food and drinks served.
“No one should go on holiday and become unwell as a result of these standards not being met, thereby ruining their holidays.
“I’m delighted we received the outcome we did for both Lilly and Jordan and advise anyone who may have had their holiday ruined due to an illness or injury to get in touch,” said Mr Walker.
Compensation won
Mr Walker requested full medical reports for Lilly and Jordan to support their claims and prognosis.
After receiving the medical reports, negotiations with the Defendant commenced, and a combined settlement of £2,700 compensation was achieved, with £1,500 awarded to Lilly and £1,200 to Jordan.
