Minibus crash victims receive £16,000 compensation payout

A British family has received £16,000 compensation after a traumatic minibus accident in Turkey, which occurred during their holiday last year.

The couple, along with their daughter, were injured when their transfer vehicle flipped over while taking them to the airport on October 28, 2022. The trip had been booked as part of a package holiday through On The Beach Group PLC.

The accident happened during the family’s transfer from their hotel in Belek, Antalya. The minibus driver lost control, mounted the curb, and caused the vehicle to overturn, injuring all three passengers, with one passenger suffering the most serious injuries, including a fractured vertebra and persistent pain in her neck, back, and hip, along with recurring headaches. Two other members of the Family sustained lesser injuries but were nonetheless affected by the traumatic event.

Following the accident, the family filed an airport transfer road traffic accident claim against On The Beach Group, citing negligence under the Package Travel and Linked Travel Arrangements Regulations 2018. These regulations hold travel organisers responsible for the safety and proper performance of services, including transfers, that are part of a package holiday.

After months of negotiations, the case was settled for £16,000, which will help cover our clients ongoing medical costs and rehabilitation. The Family expressed their relief that the ordeal was finally resolved.

Reflecting on the settlement, Rachel said, “This entire experience has been incredibly difficult for us. The accident not only left me with physical injuries but also affected our peace of mind. It’s a relief that the legal process is now behind us, and this settlement will go a long way toward covering the treatment I still need.”

Her husband added: “We went on this holiday hoping to relax and spend time as a family, but it turned into a nightmare. We’re just glad it’s been resolved, and we hope that travel companies take greater care to prevent such accidents in the future.”

The family’s solicitor, Michael Walker of Holiday Claims Bureau, who handled the case, highlighted the importance of the outcome. “We’re pleased to have secured this settlement for the Park family. This accident was entirely preventable, and it’s a stark reminder of the duty travel companies have to ensure the safety of their customers. In this case, the driver’s negligence caused significant distress and injury.

Mr. Walker further explained, “The £16,000 compensation will assist with Jennifer’s ongoing recovery, and while no amount can fully erase the trauma they endured, this resolution provides some financial relief and peace of mind.”

The family hopes that this case serves as a wake-up call for the travel industry to prioritise passenger safety in all aspects of their services.

With the settlement secured, the Family is now focused on moving forward and recovering from the ordeal, though they remain hopeful that their experience will encourage stricter safety protocols for future holidaymakers.
